GENERAL TERMS AND CONDITIONS OF PROFESSIONAL SALE
1. Object

These General Terms and Conditions of Sale (GTC) and the website's privacy policy www.japan-headspa.com govern the contractual relationship between, on the one hand, individuals wishing to purchase Head Spa equipment, hereinafter referred to as "the Customer", and on the other hand, the company Japan Head Spa, which operates the online store. www.japan-headspa.com, a simplified joint-stock company whose registered office is located at 200 rue de la Croix Nivert, 75015, Paris, France

By placing an order, the Customer acknowledges having read and accepted without reservation these Terms and Conditions and the Privacy Policy, which form an integral part of the contract. These conditions are the only applicable terms and supersede all others. Any different or conflicting conditions proposed by the Customer will not be taken into account. Any modification or additional commitment issued by Japan Head Spa must be formalized in writing. The company also reserves the right to modify these Terms and Conditions at any time.

Japan Head Spa offers Head Spa equipment for sale. Product descriptions and prices, including all taxes (VAT at 20%), are available on the website. www.japan-headspa.com.

 

3. Price

The prices of the products offered on www.japan-headspa.com Prices are indicated in euros (€) and inclusive of all taxes (TTC) for deliveries made within the European Union, including VAT and any customs duties.
For deliveries outside the European Union, prices are displayed excluding taxes (VAT and customs duties). In this case, the customer is fully responsible for paying any taxes and duties levied by their country upon entry of the goods into customs, as these charges are not covered by Japan Head Spa. The customer is also fully responsible for importing the products into their country, including compliance with local regulations.

Japan Head Spa reserves the right to revise its prices at any time without prior notice. The prices applicable to an order are those displayed at the time the shopping cart is validated. Subsequent price changes are not retroactive.
c) Order confirmation
Order confirmation constitutes acceptance of the prices in effect at that time. A confirmed order with a displayed price cannot be cancelled or modified by the customer, even if prices change after confirmation.
d) Pricing errors
In the event of a clear error in the price of a product, Japan Head Spa reserves the right to cancel the order, even if it has already been confirmed. The customer will be informed of the cancellation and will receive a full refund of any payments made.

• Promotions are valid while stocks last and cannot be combined with other discounts.
• Discounts or gifts offered as part of a promotion are valid only once and on a single order.
• Promotional offers are not eligible for cash refunds and may be changed or withdrawn at any time without notice.
• Promotional codes must be entered in the designated field in the shopping cart to benefit from the offers. These codes are valid only on products included in the promotion.

c) Booking and payment
Product availability information at the time of ordering is provided for guidance only. Items are only reserved after full payment has been received. In the event of late payment, the initially indicated stock may have changed or been depleted.

 

6. Delivery
has) Delivery zones
Japan Head Spa ships its products worldwide by collaborating with internationally renowned carriers.
b) Delivery costs
• Deliveries are free only within mainland France, excluding mountain areas and islands. A surcharge of 50 euros will be applied for deliveries to these specific areas.
• For destinations within the European Union, the United States, or the United Kingdom, additional charges may apply. These charges will be specified during the ordering process or provided by customer service upon request.
• For other countries, delivery costs are calculated based on the destination and indicated during the order process or upon request from customer service.
• An appointment will be scheduled with the carrier for delivery. If the customer is absent at the agreed date and time, an additional fee of 50 euros will be charged for rescheduling the delivery.
c. Delivery options
The customer can choose one of the following delivery times:
• 8 business days
• 50 working days
An additional preparation time of 5 to 10 days is required to secure the packaging and prevent damage during transport. This time may be extended during periods of high demand or in summer.
d. Conditions for 50-day deliveries
• Deliveries with a 50-day lead time are monitored by the logistics manager, who will contact the customer by email between 10 and 7 days before the expected delivery.
• There is no need to contact the platform before this deadline. Any inappropriate behavior will be reported to the relevant authorities.
e. Calculating delivery times
Delivery times are expressed in working days. Carriers generally do not work on Saturdays, Sundays, or public holidays.
f. Delivery conditions
The products are delivered to the address specified on the invoice, and carriers only deliver to the ground floor. They are not obligated to deliver the goods to another address or to transport them inside the premises. Ownership of the products is transferred to the customer only after full payment of the agreed price. Once the products are handed over to the carrier, the risks associated with their transport, such as loss, theft, or damage, are also transferred to the customer. The customer is required to check the condition of the goods on the day of delivery and to immediately report any anomalies or damage directly to the carrier. Any claims made after delivery will not be considered. Storage or redelivery fees, in the event of a failed delivery due to the customer's fault (absence, incorrect address), will be charged according to the carrier's rates. Returns due to defects must be reported to the carrier immediately upon delivery, with clear evidence (photos).
g. Refund Policy
Once the invoice or quote has been approved and payment has been made, no refund will be given.
h. Force majeure
Japan Head Spa cannot be held liable for delays or inability to deliver products in the event of force majeure, as defined by Article 1218 of the Civil Code. This includes, but is not limited to, strikes, natural disasters, pandemics, wars, administrative restrictions, disruptions to transport networks, or delays due to customs controls.

7. Return policy

has) Product warranty
The articles available on www.japan-headspa.com benefit from the following guarantees:

• Head Spa bed and machine (tubs only) : one-year manufacturer's warranty.
• Accessories : one-year manufacturer's warranty.
The warranty covers exclusively manufacturing defects and takes effect from the date of delivery of the products.
b. Warranty conditions
• The customer is required to inspect the goods upon receipt to identify any obvious defects or transport-related damage. Returns due to defects must be reported to the carrier immediately upon delivery, with clear evidence (photos).
• All repairs or interventions must be carried out by repairers authorized by Japan Head Spa. Failure to comply with this requirement will void the warranty. Warranty repairs or exchanges do not cover return shipping costs, except in cases of a proven defect attributable to your company. In all other cases, the customer is responsible for these costs.
• The warranty excludes:
✗ Improper use or failure to follow the instructions provided in the user manual.
✗ Normal wear and tear or deterioration due to time.
✗ Damage caused by improper use or inadequate maintenance.
✗ Breakages or defects not related to a manufacturing defect.
c. Return and refund conditions

The products sold by Japan Head Spa are intended exclusively for professional use. Consequently, even if the buyer is a private individual, any order will be considered as having been placed for professional purposes.

• No returns or exchanges will be accepted without a valid reason (error by Japan Head Spa regarding the model or a defect reported by the buyer to the delivery carrier). Products must remain unopened and undamaged.
• Cancellation possible within 24 hours of ordering (refund minus 150 euros administrative fees)
• Return shipping costs are entirely the responsibility of the customer.
• Once the invoice has been validated and payment made, no refund will be issued.
• If the merchandise is already in transit, a model exchange will not be possible. Any exchange fees will be the responsibility of the customer, and shipments via DHL or UPS Express may incur high costs.
d. Warranty limitations
• The one-year warranty applies only in the event of a manufacturing defect.
• Full details regarding warranty conditions are provided in the documentation attached to the invoice. It is recommended that you consult this document to ensure the warranty is applied correctly.

 

8. Payment method

IRegardless of the payment method used (credit or debit card), ownership of the products is transferred only after full payment has been received in the account associated with the website.www.japan-headspa.com.

9. Limitation of liability:

c) Force majeure and independent events

10. Fraud and Abuse

b) Right of cancellation
In the event of a well-founded suspicion of abuse, fraud, or unauthorized use of payment methods, Japan Head Spa reserves the right to cancel the order, even after confirmation. In this case, the customer will be informed of the cancellation, and any payment already made will be refunded, unless evidence of fraudulent intent is established.
c) Account suspension
Japan Head Spa also reserves the right to suspend or delete the account of any customer involved in fraudulent activities or activities contrary to these Terms and Conditions, without prior notice or compensation. Customer accounts closed for fraud or abuse will not be reactivated, and administrative costs or losses incurred by the company may be claimed in the event of proven damages.
d) Collaboration with the authorities
In the event of proven fraud, Japan Head Spa may transmit the necessary information to the competent authorities to facilitate the investigation.

b) Applicable law
These Terms and Conditions are governed by French law applicable to online sales, excluding the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980.
